We are the Seniors ”Shministim”

In Hebrew, graduates of 12 years of education are called “Shministim”.

Military service is compulsory in the state of Israel for young Jews under the mandatory conscription law.

We, the Shministim, high school graduates and social activists, refuse to do military service, and refuse to take part in the policy of oppression and military rule that has been imposed by the IDF in the occupied territories for over 42 years.

As a result of our conscientious objection to serve in the occupying army – an objection to take part in additional wars and continued bloodshed on both sides, and a desire for a peaceful and a just society – we are imprisoned.

Length of prison term runs between 21 to 28 days, and those refusing to wear uniform are sent to solitary confinement.

Our Goals

1. To show the Palestinian youth of our age that there is still hope, that all of us together and all of us as the future generation can make a change, and will make a change!

7. To show our grandparents that we have learnt from History, and that is why we are choosing the path of peace.

8. To show our teachers that we have chosen to educate and influence our society.

9. To instill in society the legitimacy of 18 year olds to choose their path.

10. To “civil-ize” society.

Our Letter
Senior’s Letter 2009-2010

We, the undersigned young women and men, Jews and Arabs from all parts of the country, hereby declare that we will toil against the occupation and oppression policies of the Israeli government in the occupied territories, and in the territory of the land of Israel, and therefore refuse to take part in actions related to such policies, which are carried out in our name by the Israeli Defense Force.

We are all community activists and contribute in various ways to a variety of sectors in the Israeli society. We believe that contribution, cooperation and volunteerism are a way of life, and should not be limited to just two or three years. Our conscientious objection stems directly from our volunteer experience, from the values we believe in, from our love of the society that we are a part of and in which we live, from our respect of every human being, and from the aim of making our country a better place for all of its inhabitants.

The occupation creates an unbearable actuality for the Palestinians in the occupied territories. The checkpoint policy, land annexation, the building of the apartheid wall, paving of roads for Israeli’s only, settlement projects, and assassinations – all these have been sowing destruction in the West Bank for over 4 decades. The siege on Gaza and the prevention of importing materials, including basic food products and humanitarian aid, undermines the basic minimal living conditions of Gaza’s residents.
We cannot tolerate such a reality.

The claim put forth by the spokespersons of the government and the army, that the continuation of the occupation arises from security reasons, has no substance. No country that has fought for its independence has ever been defeated by military means. The suffering of the Palestinian people and their subjugation is the cause of violent resistance. Israel’s public will never be safe as long as the Palestinian nation is under occupation. There is no military solution to the Israeli-Palestinian conflict – only peace will ensure life and security for Jews and Arabs in this country.

The Israeli government frequently boasts that Israel is “the only democracy in the Middle East”.
The occupation is a complete contradiction to this claim.
Can a government that controls the lives of millions of people who did not take part in elections be called a “democracy”? Can military rule of a civilian population be considered anything other than a dictatorship?

The Israeli Army claims that it is “the most ethical army in the world”. However, time and again reality proves that occupation and ethics cannot stand together. When young armed men are sent on policing missions in the midst of occupied disenfranchised persons, when the government attempts to repress the struggle of the disenfranchised for independence by force – the stage is set for the injury of civilian population and committing of war crimes.
Those who carry out such actions are not “exceptions” or “bad apples”. The occupation is the cess pool from in which such actions fester. The occupation has led the Israel Army to breach international treaties, UN decisions, and recommendations of the international court, and even Israeli law, time and again.

Settlement policy is racist in principle. In the name of a Messianic ideology, it has created a reality of apartheid in the West Bank. Disenfranchised Palestinians and privileged settlers live contrastive lives side by side. Settlers participate in the election of the government that administers their affairs, while the Palestinians live under military rule. Settlers enjoy social security benefits, and economic benefits, while Palestinians live a life of poverty and enslavement. Settlers are tried under Israeli law in Israeli courts, while Palestinians are tried at military courts with out the basic right of a fair proceeding. Any human opposed to racism finds this reality repulsive and untenable.

There are those who claim that we are objectors, although the Israeli government is the most consistent objector – in objecting to peace. The Israeli Army is not a “defense force”, but an aggressive occupation force. The Israeli government does not extend an olive branch, rather it upholds violent nationalism.

The occupation is a continuous crime against Israeli society. Employment of Palestinians under slave conditions in the Israeli job market causes a deterioration of conditions for all workers in the market and brings about a violation of their rights. Instead of investing in social budgets, the Israeli government has been investing for more than 40 years in the building of villas and by-pass roads in the settlements, in order to alter ground reality. The warped norms and the violence that young soldiers confess to in the territories have permeated the green line, and are expressed in a rise in violence and racism throughout Israeli society.

Out of sense of responsibility and concern for the two nations that live in this country, we cannot stand idle. We were born into a reality of occupation, and many of our generation see this as a “natural” state. In Israeli society it is a matter of fact that at 18, every young man and woman partakes in military service. However, we cannot ignore the truth – the occupation is an extreme situation, violent, racist, inhuman, illegal, non democratic, and immoral, that is life threatening for both nations. We that have been brought up on values of liberty, justice, righteousness and peace cannot accept it.

Our objection to becoming soldiers of the occupation stems from our loyalty to our values and to the society surrounding us, and it is part of our ongoing struggle for peace and equality, a struggle whose Jewish-Arab nature proves that peace and co-existence is possible. This is our way, and we are willing to pay the price.

Coexistence in Israel - YMCA Peace Preschool

The student senate at University of California Berkeley voted 16 to 4 to divest from companies that profit from Israel's occupation and war crimes. 1. International Educational Development/Humanitarian Law Project (IED/HLP) has raised the issue of weaponry containing depleted uranium at first the Commission on Human Rights and then the Sub-Commission on Human Rights since 1996. We have been pleased that the Sub-Commission immediately took up this issue and has kept it on the agenda ever since. We, of course, agree with the Sub-Commission that the use of weaponry containing depleted uranium in armed conflict is incompatible with existing human rights and humanitarian law. We have also welcomed the working papers submitted by Y.K.J. Yeung Sik Yuen on not only weaponry containing depleted uranium but on a number of other weapons whose use in armed conflict is also incompatible with existing norms. E/CN.4/Sub.2/2002/38 and E/CN.4/Sub.2/2003/35.

2. In our numerous oral and written statements on the issue of this weaponry we have set out four tests that all weapons must pass in order to be used in armed conflict: the weapons and their effect must be contained to the legal field of battle (the "geographical" test); the weapons and their effect must cease to function when the armed conflict is over (the "temporal" test); the weapons and their effect must not be unduly inhumane or cause undue suffering (the "humaneness" test); and the weapons can not unduly harm the environment (the "environment" test).

3. Mr. Yeung Sik Yuen's assessment of when weapons are to be considered banned by operation of law is stated somewhat differently but is essentially compatible with ours. However, he adds an essential element that we had not included -- the requirement that all weapons use must be in proportion to the legitimate military objectives. Thus even "legal" weapons might be used illegally -- as when using a large bomb against a small, lightly defended military outpost and causing injury and damage in excess of the actual military gain. This is an important addition, as several weapons systems are now being proposed that would severely tax this rule. One of these, being developed in the United States, would allow the United States to engage in an armed conflict anywhere in the world from its own territory. Code-named FALCON (for Force Application and Launch from the Continental United States), weapons delivery systems are being planned that would carry 12,000 pound bombs anywhere in the world in less than two hours from a US launch. As the United States would not have any military personnel on site, it would be impossible to assess proportionality. And the "enemy" would have no way at all to defend itself as the "enemy" would not have the same weapons capability. The United States is also planning smaller bombs that can be launched into space, and when guided over its target, dropped to earth. These would be able to penetrate 70 feet of solid rock. They are defended by United States officials because it "would free the US military from reliance on forward basing to enable it to react promptly and decisively to destabilising or threatening actions by hostile countries or terrorist organizations." From the Defense Advanced Research Projects Agency (DARPA) invitation for bids, posted on its website, reported by Julian Borger, The Guardian, 1 July 2003. We call wars to be waged this way "arm chair" wars. The United State military will not have to leave home, but can effectively destroy a country from their homes. The United States "combatants" never have to see combat, nor the destruction they cause with the bombs they send from home.

4. Weaponry containing depleted uranium has been increasing in the news and subject of widespread international condemnation, especially as it was so widely used in the new war against Iraq. One study of children born of United States veterans of the first Gulf War shows a more than 60% incidence of disability, deformity and other serious medical problems. Another study shows that United States Gulf War veteran' children have a much higher likelihood of having three specific birth defects: two types heart valve abnormality to children of male veterans, and genito-urinary defects to children born of female veterans. A study of British veterans of the Gulf War, Bosnia and Kosovo reveals that they have 10 - 14 times the level of chromosomal abnormalities than usual. H. Schrader, A. Heimers, R. Frentzel-Beyme, A. Schott & W. Hoffmann, "Chromosome aberration analysis in perifiral lymphocytes of Gulf war and Balkan war veterans," in Radiation Protection Dosimetry, vol.103 no.3, pp. 211-220.

5. There is increasing evidence that troubling weaponry was also used in Afghanistan, as a Canadian medical research facility found that the urine of Afghani people near where the United States carried out military operations contained radioactive isotopes 100 to 400 times higher than Gulf War veterans from the United Kingdom tested in 1999. The report is posted at www.umrc.net. The maximum permissible level for members of the public in the United States is considered to be 12 nanograms per year. The Canadian team recorded an average 315.5 nanograms in people in Jalalabad, Tora Bora and Mazar-e-Sharif. A 12-year-old boy near Kabul tested at 2,031 nanograms. After a second trip to Afghanistan, the Canadian team documented comparable results in a much broader area and larger population group. A prominent Afghani physician reports that there is a dramatic increase in birth defects in Afghanistan and people are experiencing catastrophic health consequences.

6. Regarding the use of weapons used against Iraq this spring, it is clear that much weaponry containing depleted uranium was used. For example Abrams tanks only use DU ordnance. The bombs fired on Baghdad and other cities as part of "shock and awe" are alleged to have had DU nosecones. Cluster bombs were admittedly used in urban areas in an attempt to protect British troops. Paul Waugh, "Allied use of cluster bombs illegal, minister admits," The Independent, 30 May 2003. While the amount of DU dispersed over Iraq for the second time in less than 15 years is unclear, it is clear that the United States does not intend to clean up the DU nor even fully disclose where it was used and in what amounts.

7. Our organization considers the Iraq situation an atrocity followed by a catastrophe. The international community simply must respond or risk being overtaken in every way by a power that did not and does not intend to abide by the principles of humanitarian law carefully carved out since the first Geneva Convention of 1864 and The Hague Conventions of 1899 and 1907. The weapons already in use are terrifying enough, without contemplating those planned in the future.

8. We urge the Sub-Commission to request Mr. Yeung Sik Yuen to continue his work on all these weapons. In the course of his work on this topic he has become one of the few experts in this field and the Sub-Commission is well advised to request him to prepare an additional follow up paper. Indeed, it would take years for another to catch up to his expertise. The importance of this endeavor cannot possibly be overestimated. The fate of the whole world lies in being able to carry out true disarmament. The smaller, poorer countries cannot possible keep up with "arm-chair" wars or they will bankrupt themselves. Even the other developed countries are far, far behind this technological madness. If the United States is allowed to use and develop these weapons, all other countries are reduced to peonage at the mercy of the United States. Therefore, it is essential that the international community find a way to truly rid the world of illegal weapons.

Atomic radiation has increased the number of babies born with defects in the southern provinces of Iraq.

Iraqi doctors say they' have been struggling to cope with the rise in the number of cancer cases —especially in cities subjected to heavy U-S and British bombardment.

The high rate of birth defects and cancer cases will move in the coming years to the central and northern provinces of Iraq since the radiation may penetrate the soil and water by air.

The ministry will seek compensation for the victims of these bombs.

In Honor of our very good friend Abu Obeidah Omran

"Viva Palestina and many others around the world are shocked to learn of the killing of Abu Obeidah Omran in Houston, Texas, apparently during a robbery of his grocery store.
We extend our deepest sympathies to his wife and children at this difficult hour. We send our condolences, too, to the Al Awda, Texas organization which he built and the broader Palestinian, Arab and Muslim community in the United States within which he was a unique towering, bustling icon.
It is hard to believe that this tall. strong vital man is no longer with us and has, God-willing, departed to the other, better, life.
The last time I saw Abu Obeidah, or Abu as he was known throughout Texas, he had organized a huge car cavalcade for me from Houston Airport to downtown Houston. We were accompanied throughout the procession by motorcycle outriders from the Houston police force, who stopped all traffic for us. I remarked that all the officers were African-American and Abu replied that the whole thing had been possible only through the strong relations he had built with the city's black community.
The welcome was in recognition of February's Viva Palestina convoy into Gaza. During my speech that night news came through about the murderous Israeli attack on the aid ship Mavi Marmara. The first time I saw this gentle giant was through the Viva Palestina USA convoy to Gaza on July 4, 2009.

He had thrown his heart and soul into the convoy and entered Gaza wearing his Stetson, his Texan cowboy boots and with imitation cow horns on his vehicle. He was wearing his trademark red keffiyah - he was a left wing Palestinian first and last - and was received as a hero by the Gazans. On the first day of Ramadan he left a message on my telephone, from Houston, wishing me all the best. By the time I was able to return his call his telephone was answered by someone else and Abu Obeidah was no more.
He was a simply unforgettable character. In 35 years of working in the Palestinian cause I have never come across anyone quite like him. He seemed absolutely unstoppable, a force of nature, a dynamo. Now, as a result of a stupid and petty crime, a robbery of not much I guess, he is gone. Woe is me and all of us. His death tolls for all who loved Palestine, loved justice, loved life.
May God grant him heaven and have mercy on his soul."

In the House of Parliament. SIR Gerald Kaufman, the veteran Labour PM,
compared the actions of Israeli troops in Gaza to the Nazis who forced his family to flee Poland.

During a Commons debate on the fighting in Gaza, he urged the government to impose an arms embargo on Israel.

Sir Gerald, who was brought up as an orthodox Jew and Zionist, said: "My grandmother was ill in bed when the Nazis came to her home town a German soldier shot her dead in her bed."

The Unanimous Declaration of the Thirteen United States of America

When, in the course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume among the powers of the earth, the separate and equal station to which the laws of nature and of nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.

He has refused his assent to laws, the most wholesome and necessary for the public good.

He has refused to pass other laws for the accommodation of large districts of people, unless those people would relinquish the right of representation in the legislature, a right inestimable to them and formidable to tyrants only.

He has called together legislative bodies at places unusual, uncomfortable, and distant from the depository of their public records, for the sole purpose of fatiguing them into compliance with his measures.

He has dissolved representative houses repeatedly, for opposing with manly firmness his invasions on the rights of the people.

He has refused for a long time, after such dissolutions, to cause others to be elected; whereby the legislative powers, incapable of annihilation, have returned to the people at large for their exercise; the state remaining in the meantime exposed to all the dangers of invasion from without, and convulsions within.

He has constrained our fellow citizens taken captive on the high seas to bear arms against their country, to become the executioners of their friends and brethren, or to fall themselves by their hands.

He has excited domestic insurrections amongst us, and has endeavored to bring on the inhabitants of our frontiers, the merciless Indian savages, whose known rule of warfare, is undistinguished destruction of all ages, sexes and conditions.

In every stage of these oppressions we have petitioned for redress in the most humble terms: our repeated petitions have been answered only by repeated injury. A prince, whose character is thus marked by every act which may define a tyrant, is unfit to be the ruler of a free people.

Nor have we been wanting in attention to our British brethren. We have warned them from time to time of attempts by their legislature to extend an unwarrantable jurisdiction over us. We have reminded them of the circumstances of our emigration and settlement here. We have appealed to their native justice and magnanimity, and we have conjured them by the ties of our common kindred to disavow these usurpation's, which, would inevitably interrupt our connections and correspondence.They too have been deaf to the voice of justice and of consanguinity. We must, therefore, acquiesce in the necessity, which denounces our separation, and hold them, as we hold the rest of mankind, enemies in war, in peace friends.

We, therefore, the representatives of the United States of America, in General Congress, assembled, appealing to the Supreme Judge of the world for the rectitude of our intentions, do, in the name, and by the authority of the good people of these colonies, solemnly publish and declare, that these united colonies are, and of right ought to be free and independent states; that they are absolved from all allegiance to the British Crown, and that all political connection between them and the state of Great Britain, is and ought to be totally dissolved; and that as free and independent states, they have full power to levey war, conclude peace, contract alliances, establish commerce, and to do all other acts and things which independent states may of right do.
